Student Government Constitution
(Sept. 2006)

| Article I – Name |
| Section I: |
The name of the organization shall be the Eastfield College Student Government Association |
| Article II – Purpose |
The purpose of this organization shall be: |
| Section I: |
To serve as the representative body for currently enrolled students of Eastfield College |
| Section II: |
To take an active role in decision making processes and serve in a variety of leadership capacities. |
| Section III: |
To actively represent the needs and interest of Eastfield college student body |
| Section IV: |
To attempt to solve problems and provide the means for discussing problems and provide the means for discussing issues relating to the Student Government Association and students. |
| Section V: |
To work towards the mission and goals of Eastfield College. The mission of Eastfield College is to provide educational opportunities through high-quality instruction, services and programs in an environment conducive to student success in academic, technical, occupational, and continuing education.
Eastfield’s purpose is to develop responsible citizenship, to value diversity and cultural enrichment, and to be accountable and adaptable. |
| Article III – Membership |
| Section I: |
Eastfield College Student Government representatives are either elected or selected by qualified applications as specified:
- Completion of an official packet
- Presentation of an official college (or school) transcript from the last attended academic institution. A minimum GPA of 2.0 is required.
- Presentation of a current class paid fee receipt. A minimum of 6.0 credit hours per semester is required. All students must be currently enrolled in Eastfield College and must be in good standing.
- Presentation of an official nomination form from a current Eastfield College faculty member or faculty member from another educational institution.

| Section II: |
Sixteen representatives serve on the Student Government
Association for the period of one academic year. |
| Section III: |
Qualified applicants (see section I) will be elected by the student body each Fall semester. EXCEPTION: If sixteen or fewer qualified applicants apply, then those applicants will
automatically serve as the representatives of Student
Government Association. No election will occur if there are sixteen or fewer qualified applicants. |
| Section IV. |
Student Government Association representatives may serve no more than three consecutive years, and no more than four years in total. |
| Section V. |
Student Government Association representatives may not
belong to any other Student Government Association in the DCCCD Colleges. |
| Article IV – Officers |
| Section I: |
Officers shall consist of President, Vice-President, Secretary
and Communications Officer. |
| Section II: |
Duties of Officers
- The duties of the President shall be:
- to preside over all Student Government Association and Officer Meetings
- to serve as primary leader, maintain order, ensure fairness, and be neutral on positions
- to vote only in the event of a tie
- the President may not hold an executive office in any other Eastfield College organization
- to call meetings to order, ensure a quorum is present, to guide the group through the order of business and adjourn meetings
- to enforce all provisions of this constitution, the parliamentary authority, and any other standing rules that the Student Government Association may adopt.
- to prepare agendas for Student Government Association meetings
- to enforce and see that all members uphold the purpose of the Student Government Association
- to recognize speakers, ensure motions are clearly stated. Preside over debates, and call for votes
- to represent the Student Government Association in public forums, to all media and at official functions
- to serve as chief spokesperson of the Student Government Association
- to call special meetings of the Student Government Association and Executive Board
- to attend all Executive Board Meetings
- The duties of the Vice President shall be;
- to execute the duties of the President in his/her absence
- to work with all committee chairs in order to ensure that work is progressing as needed
- to attend all Executive Board meetings
- The duties of the Secretary shall be:
- to record the official minutes of each meeting and to submit copies to the Student Government Association, Student Body, and Director of SPAR. All Minutes shall be completed within one week of each official meeting.
- to execute the duties of the President in the absence of the President and Vice-President
- to take roll at the beginning of each meeting and determine the presence of a quorum
- to make sure all necessary supplies are available for the meetings
- to answer those questions presented in meetings relating to facts and procedures of the Student Government Association and have at hand, important documents relating to the Student Government Association
- to attend all Executive Board meetings
- The duties of the Communications Officer:
- to update and maintain the Student Government Association website
- to maintain the Student Government Association bulletin board
- to communicate special information to the college campus community as needed
- to coordinate special events, conferences and promotions inside and outside Student Government Association
- to arrange publicity around campus for Student Government Association
- to maintain communications related to the Student Government Association’s purpose at Eastfield College

| Section III: |
All officers shall serve as the “Executive Board” and meet
monthly in order to plan and coordinate work and follow up on committees |
| Section IV: |
Officer Elections
- The election of officers shall take place each Fall by the Student Government Association membership
- Nominations for Officers are to be made by the Student Government Association membership. All nominees must agree to serve an entire year.
- Student Government Association members may run for only one officer position
- Student Government Association who is running for an officer position must announce his/her intention prior to the election.

| Article V –Advisor (Liaison) |
| Section I: |
The Director of Student Programs and Resources at Eastfield College shall serve as the Administrative Liaison to the Student Government Association. |
| Section II: |
The duties of the Advisor (Liaison) shall be:
- to advise on all business of the Student Government Association
- to guide and to ensure that all policies are upheld
- to provide training for officers in parliamentary procedures

| Article VI – Meetings |
| Section I: |
Regular scheduled meetings shall be held on the 1st Friday of the month at 12:30 pm. Location will be announced prior to each meeting. Regular, scheduled meetings are open to the Student Body. Regular meetings occur during the Fall and Spring semesters only. |
| Section II: |
Funding meetings shall be held three times per semester;
Fall: October, November, December
Spring: February, March, April
Funding meetings shall be the 3rd Friday of these months, at 12:30 pm. Funding meetings are closed to the Student Body, and open only to those Clubs seeking funding. |
| Section III: |
Supplementary meetings shall be called by the Student Government Association for specified purposes. Supplementary meetings require a quorum in order to hold official business. |
| Section IV: |
All meetings and business conducted by the Student Government Association shall follow the current publication of “Robert’s Rules of Order”. |
| Section V: |
Coordination of all official meetings and activities must be approved by the Director of SPAR prior to any meeting or activity. |
| Section VI: |
Voting by proxy is not allowed at any meeting. |
| Article VII –Quorum |
| Section I: |
In order to conduct business in an official meeting Student Government Association must have a simple majority of the total members present |
| Section II: |
In the event a quorum is not present, the meeting shall be scheduled for another date |
| Article VIII –Legislation |
| Section I: |
The Student Government Association is financially supported through the Student Life budget, and all business transacted on behalf of the Student Government Association must adhere to official DCCCD policies and regulations |
Article IX – Amendments |
| Section I: |
This Constitution may be amended at any regular or called meeting of the Student Government Association by a simple majority vote of the members, provided that the amendment has been presented in writing to the Executive Board

| Section II: |
All amendments submitted for consideration must be submitted one week prior to the meeting |
BY-LAWS
| Article I –Members |
| Section I: |
Membership qualifications and services are specified in the Student Government Association Constitution (Article III) |
| Section II: |
Rights and Responsibilities
- Members must serve on at least one committee and actively participate in that committee
- Members must participate in at least two Student Government Association projects per semester
- All members are required to attend each official meeting
|
| Section III: |
Resignation
- If a resignation occurs in the membership, the member shall submit a resignation letter to the SGA president, one week prior to an official meeting. The resignation letter should be put to a vote of courtesy and passed with a 2/3 membership vote.
- The member may return to Student Government Association in good standing depending on the reason for resigning in the first place; the Executive Board shall vote to accept or deny membership of the member in such case

| Section IV: |
Expulsion
- Members who fail to follow membership rights and responsibilities stated in Article I-Section II of these by-laws shall be presented to the Student Government Association for consideration of continued membership in the Student Government Association
- Members are allowed to present other members to the Student Government Association for the specific purpose of expulsion from the organization. Members that present other members to the Student Government Association with false or unspecific reasons shall be presented to the Student Government Association for continued membership or expulsion from the Student Government Association, and a public apology
- Members who miss more than two SGA meetings shall be presented to the Student Government Association for consideration of continued membership in Student Government Association
- Members should be prompt for meetings. When a meeting commences each member is allowed a fifteen minute window of arrival before they are counted tardy. Three tardies, without prior notice to the Executive Board or SPAR Director, constitutes one regular absence
- In all these cases a simple majority vote shall determine if the individual member shall be allowed to continue membership, or expulsion from the Student Government Association is warranted.

| Section V: |
Vacancies
- Should a vacancy occur by resignation, or expulsion among the Membership, the position may be filled according to the membership qualification specified in Article III of the Student Government Association Constitution
- Student Government Association may vote whether or not to fill any vacated position
- Should the Student Government Association vote to replace a vacated position, new application forms will be required, and membership criteria shall be required as specified in the Student Government Association Constitution
- If more than one qualified application is submitted for each vacated position, the position will be filled according to a “first come, first served basis”, meaning that the first qualified application to submit the completed application packet will be selected to serve in the vacated position
- The SGA advisor and Executive Board will be responsible for verifying application criteria and submission dates and time

| Article II – Officers |
| Section I: |
The Officer positions, elections/nominations, eligibility, term of office and duties are specified in Article IV of the Student Government Association Constitution |
| Section II: |
Removal from Office
- If an Officer fails to perform the described duties stated in the Student Government Association Constitution, they shall be removed from office and a replacement shall be appointed by the Student Government Association
- Recommendations for removal from Office can be submitted by a member of the Executive Board. Also, any member can request that an Officer should be removed from Office. Removal from Office requires a 2/3 majority vote of the Student Government Association at any official meeting or special meeting
- The membership may, by 2/3 vote, suspend this rule in the case of extenuating circumstances
- In the event that the President is removed from Office, the Vice-President shall assume Office of the President. At this time the Executive Board shall appoint a new Vice-President upon a vote of 2/3rds majority. In the event that the Vice-President declines the Office of President, they shall occupy the office temporarily until such time as a new President is appointed in accordance with a vote of 2/3rds majority approval. The Vice-President shall not relinquish their existing duties in this situation. The membership shall be responsible for conducting an appeal vote, if requested

| Article III – Meetings |
| Section I: |
Meeting dates and times are specified in the Student Government Association Constitution |
| Section II: |
Quorum to do business shall constitute the simple majority of the Members |
| Section III: |
Special meetings can be called by the Student Government Association President with specific purpose and should be approved by the SGA advisor. Special meetings should be announced to the Student Government Association at least one week prior to the date it is appointed |
| Section IV: |
Cancellation of any regular scheduled meeting should be for inclement weather or emergency situations. In case this happens, the SGA advisor shall announce to the Student Government Association that the meeting is cancelled, and he/she shall determine a new date for the meeting |
| Article IV – Executive Board |
| Section I: |
All Officers shall serve as the Executive Board |
| Section II: |
The Executive Board shall meet at least once a month |
| Section III: |
Removal from Board shall follow the same rules as stated in Article III – Section II of these by-laws |
| Section IV: |
The duties of the Executive Board are:
- to act as representatives as stated in Article IV – Section II of the Student Government Constitution
- to plan and coordinate work for Student Government meetings and committees
- to follow up on Committees

| Article V – Committees |
| Section I: |
Standing Committees shall be:
- Facilities Committee
- Academics Committee
- Student Services Committee
- Public Relations Committee
- Bookstore/Food Services Committee
|
| Section II: |
Description of Committees
- Facilities Committee focuses on the improvement and beautification of our campus. It deals with suggestions and complaints, including but not limited to facility issues
- Academic Committee focuses on any issues involving curriculum, faculty/professors, or Course related complaints
- Student Services Committee focuses on improving the services for students on campus, including but not limited to Student Clubs and Organizations and anything else that falls under an area that directly affects students of Eastfield College
- Public Relations Committee focuses on promoting awareness and involvement of the Student Government Association. This Committee is also responsible for organizing and promoting community service activities, promotional tables in the Pit, promoting Student Government meetings, coordination of surveys and any other publicity events
- Bookstore/Food Service Committee deals with all complaints and inquiries for our Campus Bookstore and food service contractors

| Section III: |
Standing Committees shall consist of a Chair, Co-Chair and members. Chairs and Co-Chairs shall be limited to their respective positions for one Committee only |
| Section IV: |
Standing Committees shall have at least 4 members serving on the Committee for it to function. Membership shall be selected when Officers are selected and it can be assigned, or the members can volunteer to serve in the Committee they prefer. If vacancies occur, they shall be filled with new representatives appointed at an official meeting by those members currently serving in that Committee |
| Section V: |
Duties and responsibilities
- Standing Committees must meet at least once before any regular or funding meeting
- Standing Committee members can miss only one meeting per semester/ Should a member miss more than one meeting, the Vice-President will bring the issue before the Student Government for a vote of continued membership in the Student Government Association
- Standing Committees shall give a Report at each meeting
- Standing Committees must give a Report of Activities and meeting to the Vice-President before an official meeting

| Article VI– Parliamentary Authority |
| Section I: |
“Robert’s Rules of Order” shall be the official rule book by which the Student Government Association operates |
| Article VII –Amendments |
| Section I: |
These By-Laws may be amended at any regular or called/special meeting of the Student Government Association by 2/3 of the members, provided that the amendment has been presented in writing to the Executive Board |
| Section II: |
All amendments submitted for consideration must be submitted one week prior to the meeting |
